GENERAL TERMS OF SALE Nausicaá – CENTRE NATIONAL DE LA MER

Temporary access rights to the Nausicaá Centre National de la Mer and its services sold to private customers (the Purchasers or the Purchaser) at its ticket offices, via its online ticketing service or via its authorised resellers and/or partners are subject to these general terms of sale.

 

The Purchaser declares that they accept, without restriction or reservation, these general terms of sale, which are available both from Nausicaá's ticket office and on its website.

 

These general terms of sale can be consulted by the Purchaser at any time, either by verbal request at the Nausicaá ticket offices or online by clicking on the "General terms of sale" section accessible from the ticket sales page.

Information on the products and services offered for sale

Nausicaá offers tickets for sale at its ticket offices or on its website at www.nausicaa.fr, conferring the right of temporary access, with the necessary characteristics of its services with regard to the provisions of Article L 111-1 of the French Consumer Code, which enables the Purchaser to be informed of, in a legible and comprehensible manner, prior to placing a final order:

 

1° The principal characteristics of the service, in consideration of the communication medium used and the goods or services concerned, i.e. a leisure and cultural park dedicated to the sea and the oceans, consisting of aquariums and entertainment. Nausicaá also offers for sale cultural and leisure products related to the sea and oceans in its dedicated shop on its physical site in Boulogne-sur-Mer, Boulevard Sainte Beuve.

 

2° The price of the goods or services, in accordance with Articles L.112-1 to L.112-4 of the French Consumer Code, namely:

 

Ticket prices are quoted in Euros and include all taxes. They incorporate the VAT applicable on the day the order is placed. All orders, regardless of their origin, are payable in Euros.

 

Nausicaá reserves the right to change the prices at any time. Tickets are charged on the basis of the rates in force at the time the orders are recorded, and are subject to availability.

 

Web Family Adult and Web Family Child tickets are only available with a minimum purchase of 4 tickets. At least one adult ticket (18 years or older) must be purchased to order Nausicaá tickets online.

 

3° The validity and expiry dates of the tickets purchased or ordered are mentioned in the online order form or stipulated prior to purchase at the ticket offices or via retailers and/or authorised partners.

 

4° Nausicaá's head office and place of business are located at BOULEVARD SAINTE BEUVE BP 189 62203 BOULOGNE SUR MER CEDEX. Nausicaá is represented by its General Manager, Mr Christophe Sirugue.

 

5° The possibility of using a consumer mediator under the conditions stipulated in Title I of Book VI of the French Consumer Code.

 

Nausicaá is a signatory of the Médiation Tourisme et Voyage charter. The Purchaser may submit any dispute with Nausicaá to prior mediation in accordance with the rules set out in this charter.

 

The Mediator may only be called upon if the customer has previously contacted Nausicaá through its customer care service to settle the dispute. In the event of a referral to Nausicaá and without a response from it within 60 days, the Purchaser may have access to mediation with the association Médiation du Tourisme et du Voyage via its website: http://www.mtv.travel/

 

The deadline for applying for mediation is one year after the first complaint made to Nausicaá.

 

The Purchaser remains free to appeal to the courts under ordinary law, in which case the mediation is null and void.

Conditions particulières à l'activité "Dans les pas d'un soigneur"

  1. Nausicaá se réserve le droit d’annuler cette prestation en cas de force majeure. En cas d’annulation à l’initiative de Nausicaá, nous vous proposerons le report de votre prestation à une date ultérieure, selon les disponibilités. En cas d’impossibilité de report, l’intégralité des sommes versées vous seront remboursée ; aucune autre indemnité ne pourra être réclamée (frais de transports, etc.)
  2. Pour toute prestation ‘Dans les pas d’un soigneur’ annulée à la demande du client la totalité du montant de votre prestation restera acquise à Nausicaa. En cas de non présentation du client à l’heure voulue, il ne sera procédé à aucun remboursement.

Processing of personal data - Compliance with GDPR of 27 April 2016

The processing of the purchaser's personal data is legally permissible because it is necessary for the performance of the contract for the sale of tickets for admission to Nausicaá, the prices of which vary according to the age of the persons and the methods of payment entail the communication of personal data (last name, first name, IP address, bank details, postal address, etc.) (article 6.1.b of Regulation (EU) 2016/679 of the European Parliament and of the Council - hereinafter referred to as the GDPR - of 27 April 2016)

 

The purpose of the processing is exclusively the necessary formalisation of the sales contract and the electronic payment procedures.

 

Any other processing of the purchaser's personal data will require the purchaser's prior free, informed and explicit consent. In particular, personal data may not be processed for commercial prospecting, except with the purchaser's specific, free, informed and explicit consent. (article 6.1.a of the GDPR)

 

Nausicaá reminds the purchaser of their right of access, rectification, deletion, limitation, opposition - in particular to commercial prospecting - portability, withdrawal, the right to lodge a complaint with the French Data Protection Authority (CNIL), the right to know whether the collection of data is of a regulatory or contractual nature or is a condition for the conclusion of a contract, the existence of automated decision-making, including profiling, and the possibility of subsequent processing.

 

The data controller is Nausicaá - Société d'exploitation du Centre National de la Mer - a semi-public company with a capital of 1,809,560 euros, with registered office located at Boulevard Sainte Beuve, RCS Boulogne-sur-Mer no. 378 074 744, represented by its delegated General Manager in office.

 

The contact details of the Data Protection Officer (articles 37 to 38 of the GDPR) will be accessible from the Nausicaá website under the specific tab PERSONAL DATA.

 

Nausicaá keeps a record of processing activities in accordance with Article 30 of the GDPR.

 

Ticket order forms and invoices are archived on a reliable and irreversible medium such that they correspond to a reliable and durable copy, in accordance with Article 1379 of the French Civil Code.

 

Nausicaá guarantees that the processing of the purchaser's personal data complies with the GDPR, in particular with regard to its articles 5 (principles relating to the processing of personal data - lawfulness, fairness and transparency; limitation to specific, explicit and legitimate purposes; data are adequate, relevant and limited to what is necessary for the purposes for which they are processed; accurate and kept up to date; kept for no longer than is necessary for the purposes for which they are processed; processed in a manner that ensures the appropriate security of the data) 6 (lawfulness of processing - including consent of the individual for a specific purpose or purposes), 7 (free, informed and explicit consent), 8 (prohibition on obtaining consent for the processing of personal data by a child under the age of 16 directly from the child), 9 (prohibition of the processing of personal data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs or trade union membership, as well as the processing of genetic data, biometric data for the purpose of uniquely identifying a natural person, data concerning health or data concerning the sex life or sexual orientation of a natural person) 12 (transparency of information and communications and modalities for the exercise of the rights of the data subject) 13 (information to be provided where personal data are collected from the data subject: identity and contact details of the controller, contact details of the data protection officer, purposes of the processing and legal basis of the processing, if applicable the legitimate interest pursued by the controller, recipients or categories of recipients of personal data, possible transfer of data to a country outside the EU, retention period, information to the person on his/her right of access, of access, rectification, erasure, restriction, opposition - in particular to commercial canvassing - portability, withdrawal, right to lodge a complaint with a supervisory authority, right to know whether the collection of data is of a regulatory or contractual nature or is a condition for the conclusion of a contract, the existence of automated decision-making, including profiling, the possibility of further processing) 14 (information to be provided where personal data have not been obtained from the data subject) 15 (Right of access, including information on the purposes of the processing, the categories of data concerned, the recipients, the storage period, the existence of the rights stipulated in Article 12, the existence of appropriate safeguards in the event of transfer to countries outside the EU, the right to obtain a copy of the data recorded) and Articles 16 to 22.

 

Nausicaá implements a compliance approach by carrying out a "PIA" - Privacy Impact Assessment - or data protection impact analysis in accordance with article 35 of the GDPR of 27 April 2016.

 

The PIA compliance approach is based on two pillars:

 

1. The fundamental principles and rights (specific, explicit and legitimate purpose; adequate, relevant and non-excessive data; clear and complete information to individuals; limited retention period; right of opposition, access, rectification and deletion, etc.) which are "non-negotiable" and which are established by law and must be respected, regardless of the nature, seriousness and likelihood of the risks incurred;

 

2. The management of privacy risks, which determines the appropriate technical and organisational controls to protect the data.

Who has access to your data?

Nausicaá does not disclose or market your personal data to external companies.

 

We may use external service providers to process this data for the purpose of providing you with a better service.

 

The people who have access to your data are:

• The various Nausicaá departments involved in using and processing your data (marketing department, sales, shop, reception, etc.)

• Marketing service providers and advertising agencies with which Nausicaá is associated

 

How long do we keep this data?

The data is kept at least as long as it is needed to fulfil the contract.

 

The data may then be stored and processed for 3 years following your last contact, for the purpose of commercial prospecting.

RESPECT FOR FUNDAMENTAL PRINCIPLES AND RIGHTS + MANAGEMENT OF RISKS RELATED TO DATA SECURITY = COMPLIANCE

 

To carry out its PIA, Nausicaá:

• delineates and describes the context of the processes under consideration;

• analyses the measures that ensure that the fundamental principles are respected: the proportionality and necessity of the processing and the protection of the rights of the data subjects;

• assesses the privacy risks related to data security and ensures that they are adequately addressed;

• formalises validation of the PIA in view of the preceding points or decides to revise the preceding steps;

 

The PIA is a continuous improvement process. The PIA is implemented as soon as a new personal data processing operation is conceived.

 

Nausicaá undertakes to protect the security and integrity of any personal data it may process, particularly with its IT subcontractors.

 

Where appropriate, Nausicaá will implement codes of conduct and certification mechanisms for its personal data processing in accordance with Articles 40 and 42 of the GDPR of 27 April 2016.

 

Nausicaá ensures that data is only transferred to countries outside the EU under the conditions set out in Articles 45 (Commission's adequacy decision) or 46 (transfer with appropriate safeguards)

 

Minors - Identity

Minors are not allowed to purchase tickets either online or at Nausicaá's ticket offices or through its authorised resellers and/or partners.

 

Minors must be accompanied by an adult when visiting the Nausicaá site. Nausicaá may verify the age and identity of any person prior to granting access to its site.

Methods of payment

Cash payments are permitted up to a limit of one thousand euros per purchase.

 

Payment by credit card is recommended.

 

Payment can also be made by bank transfer with the order details to the Nausicaá bank account.

 

Payment by cheque upon presentation of proof of identity at the ticket offices

 

Nausicaá safeguards the security of the payment information provided by the Purchaser.

 

Validation of the order by means of the credit card number and its expiry date is equivalent to a mandate to pay the price including all taxes at the time of order. Card details are only kept for the time it takes to process the order.

 

Nausicaá retains ownership of the admission rights sold until the price has been paid in full.

 

Acceptance of the General Terms of Sale

 

The Purchaser, at the same time as they acquire an admission right to Nausicaá either online or at its ticket offices in BOULOGNE-SUR-MER, or via its retailers and/or approved partners, accepts and adheres to these general terms of sale.

 

Offer subject to availability

 

Offers for tickets and prices are valid within the limits of the number of tickets available. Tickets for the current day are on sale online until 3 hours before the Centre closes. After this time, the Purchaser must choose another day to visit.

Ticket validation

As soon as the order has been paid for and validated, the Purchaser must print out the admission tickets or save them on any reliable electronic medium and go to the Nausicaá ticket offices with these tickets.

 

The ticket and the associated service are considered to have been used on the date when the tickets are first presented at the Nausicaá ticket office.

 

Any other ticket printed with the same order number will no longer be valid.

Conditions 

The Internet user purchases a subscription online:

Adult subscription: €65

Children's subscription: €50

And they present a voucher (in the form of a ticket) at the info point or at the ticket office to activate their subscription.

Validity

The season pass is valid for one year, and its activation period 365 days.

 

Duty of care and discretion - Intellectual property

The Purchaser must also exercise discretion with regard to the information provided at the time of any payment, particularly online.

 

All material on the Nausicaá website, whether visual or audio, including the underlying technology, remains its property.

Order Confirmation - Invoices

Each online order is confirmed by an e-mail, which can be printed out online, giving details of the order, item by item, and the amount expressed in Euros, including all taxes.

Responsibility

Subject to its specific obligations with regard to the processing of personal data and the security of its automated data processing systems, "Nausicaá" cannot be held liable for any inconvenience or damage inherent in the Internet network, in particular a disruption of service, an external intrusion or the presence of computer viruses, or in cases of force majeure.

 

Completeness

In the event that one of the clauses of this contract is rendered null and void by a change in legislation or regulations or by a court decision, this will in no way affect the validity of and compliance with these general terms of sale.

 

Duration

These terms apply throughout the entire period that the services offered by the company "Nausicaá" are online.

Proof

The IT records, kept in Nausicaá's computer systems under reinforced security conditions, will be considered as proof of communications, orders and payments between the parties.

Applicable law - disputes

This contract is governed by French law.

The language of this contract is French.

NAUSICAÁ 2024 General Terms and Conditions of Sale relative to group visit services

  1. GROUP BOOKINGS

How to book:

The booking request must be made using: The booking form available on the www.nausicaa.fr website or with our booking service:  from 9am to 5.30pm everyday except Saturdays, Sundays and public holidays resa@nausicaa.fr  phone: +33 (0)3 21 30 99 89

The “Groups” tariff conditions apply for all groups, consisting of the number of people required for the application of these rates, and that have been the subject of prior booking with Nausicaá, at least 3 working days before the date of the visit. Any requests for booking sent after this deadline will be examined case by case in line with availabilities.

All the members of the group must present themselves together at the entrance and at the restaurant, at the time indicated on the booking confirmation.

Booking confirmation:

The booking becomes firm when Nausicaá receives the duly signed booking contract and the down payment of 50% of the amount of the order before the end-of-option date: otherwise the options will not be maintained.

For civil service departments, an order form validated by the paying organisation will be required, indicating the number, type of tickets and amount owed.

For bookings with catering services, the choice of menu must absolutely be included with the signed contract: otherwise and without any indication being given 8 days before the date of the visit, Nausicaá will be obliged to draw up the menu without customer input.

Booking confirmed by email implies unreserved acceptance by the customer or of its representative of these terms and conditions, a signed copy of which must be attached with the signed contract returned.

  1. RATES AND APPLICATION CONDITIONS

The price of the services is indicated Inclusive of All Taxes per person and corresponds to the rates that apply for the chosen date. The rates may be subject to change without notice, including during the season.

The specific terms and conditions linked to each category of groups may be applied. Thus:

A school or school-related group, consisting of 80% children:

  • aged between 6 and 18 inclusive, may benefit from one free adult admission ticket per 10 paying children’s tickets,
  • aged between 3 and 5 inclusive, may benefit from one free adult admission ticket per 7 paying children’s tickets.

The other groups may benefit from one free adult admission ticket per 20 paying tickets.

The free tickets are granted on the basis of the number of people booked calculated excluding the driver and children aged under three

people with a disability may benefit from a pre-booking – a special rate and one free ticket per 7 paying tickets, only if the booking is made by a disabled person’s hosting organisation.

  1. INVOICING-PAYMENT

A down payment of 50% of the amount of the order is required if the confirmation arrives at the booking service between 21 and 60 days before the date of the visit.

The balance of the order must be paid at the latest 20 business days before the date of the visit.

In the event of an incident or non-payment, Nausicaa reserves the right to suspend the totality or part of the current orders. It is also stipulated that Nausicaa reserves ownership of the Services, in particular of the tickets until all the sums owed by the customer have been received.

For deferred payments using order forms or vouchers, payment is due on receipt of the invoiceIn the case of late payment, the amounts unpaid shall bear interest at three (3) times the legal interest rate as from the due date indicated on the invoice until the date of effective payment, along with an indemnity of forty (40) euros to cover the recovery costs. The customer will have to pay this interest without the need for any prior notification.

Advance reception of the tickets

On reception of the balance or of the order form, the e-tickets will be sent automatically unless otherwise indicated by you.

  1. ORDER FOR RELATED SERVICES

Any order for related services is subject to the same payment terms and conditions as for the main order to which it is attached (art.3)

  1. ACCOMPLISHMENT OF THE SERVICE

The customer undertakes to arrive on the days and at the times indicated in the booking confirmation. If this is not possible, it undertakes to notify Nausicaá at the earliest opportunity, and the latter may have to modify the course and length of the visit, or to cancel it after having previously informed the customer on its arrival.

  1. MODIFICATIONS AND CANCELLATION

There are fewer people in the group than planned

 

The headcount notified by the customer 8 days before the visit will serve as the basis for invoicing. The customer will be sent the exact number of tickets relative to this confirmation, for which it has paid.

Any requests to modify or cancel an order must be sent in writing to the booking service by email, to the following address: resa@nausicaa.fr

They are subject to availability and may lead to a price change in the case of a change in the number of people.

In any event, Nausicaá will apply the following charges for any partial cancellation of a booking confirmed in writing:

Up to D-9: no charge for a modification of the headcount.

From D-8 to D-day: The cancelled tickets will be invoiced 100%

Special terms and conditions for related services and catering

From D-15 to D-day: any change in the headcount or cancellation of a booking will be invoiced 100%

There are more people in the group than planned

In the case of an increase in the headcount, admission tickets may, subject to availability, be added when the group leader comes to the cash desk. They must be paid for on the spot at the individual rate. (No invoice or free tickets)

Total cancellation by the customer (tickets, related services and catering)

Any total cancellation of a confirmed booking must be notified to Nausicaá in writing. Only cancellations approved and confirmed by Nausicaá are deemed to have been accepted.

In any event, Nausicaá will apply the following charges for any total cancellation of a confirmed booking, that is not cancelled within the following deadlines:

from D-day to D-8: 100% of the total amount invoiced

Non-attendance of a group whose confirmation has been confirmed, and not cancelled, will lead to the application of the following penalties: 100% charge of the total amount indicated in the booking contract.

Special terms and conditions for related services and catering

From D-15 to D-day: any change in the headcount or cancellation of a booking will be invoiced 100%

Cancellation by Nausicaá

Nausicaá reserves the right to cancel any booking in the case of force majeure events or unforeseeable circumstances that force it to do so, such as non-exhaustively: fire, water damage, storms, impossibility of access, pandemic. In this case, if the service cannot be postponed, a total refund will be made. In no event may the customer claim any indemnity.

Nausicaá reserves the right to close a space exceptionally for the proper functioning of the site.  And this may not in any event serve as a reason for indemnification for the customer.

  1. LIABILITY AND INSURANCE

During the visit, the visitors are subject to the internal regulations posted at the entrance https://www.nausicaa.fr/en/visit-rules/.

The couriers are responsible for their group, even in the presence of a Nausicaá guide or member of staff. Each visitor is responsible for any damage, whether direct or indirect, that they may cause during their presence on the Nausicaá site.

In the case of a disturbance, Nausicaá reserves the right to require the visitors concerned to leave immediately without any right of recourse. The visitors

who are expelled in this context will not in any event be able to obtain a refund of their admission tickets. Nausicaá, accepts no liability for any damage of any nature whatsoever that could have an impact on the effects, objects or materials introduced by the visitors.

  1. COMPLAINTS

In the case of complaints further to a disagreement concerning the execution of the services that are the subject of this document, the Customer undertakes to pay without delay the undisputed part and immediately inform Nausicaá of the reason for its complaint which must be real and serious. Complaints must be made in writing and sent by recorded delivery letter at the latest 8 days after said service.

Any invoice that has not been disputed in line with the procedure described above will be considered to have been accepted.

These General Terms and Conditions of Sale are subject to French law, both for their interpretation and their implementation. Failing amicable settlement, disputes must be submitted to the Boulogne-sur-Mer Tribunal that has jurisdiction over Nausicaá.

Nausicaá has signed the Tourism and Travel Mediation Charter. The buyer has the possibility of submitting any dispute with Nausicaá to prior mediation in line with the rules given in this charter. http://www.mtv.travel/

The Buyer is always free to resort to common law judicial channels, mediation then being null and void.

  1. PROCESSING OF PERSONAL DATA

Compliance with GDPR of 27 April 2016

The processing of the buyer’s data of a personal nature is licit because it is necessary for the execution of the contract for the sale of Nausicaá admission tickets whose price varies according to the age of the people and whose payment methods require the disclosure of data of a personal nature (article 6.1.b of regulation (EU) 2016/679 of the European Parliament and Council – (hereinafter GDPR of 27 April 2016). The purpose of the processing exclusively lies in the formalisation required for the sales contract.
